Grief Matters: Understanding and Working with Grief in Contested Probate Disputes, Elder Abuse Cases and Adult Family Elder Mediation

Even though grief is at the heart of most, if not all, contested probate, elder abuse and adult family elder mediations, the subject of grief is neglected in the professional education of mediators, collaborative lawyers or litigators.  Yet, the way these professionals respond to grief strongly influences the quality of their relationships with their clients or parties; the quality of and potential for resolution; and their own experience of the process.


In this workshop, Dana Curtis & Richard Collier, both mediators and lawyers who represents clients in mediations involving trusts and estates, and Stacey Carr, a bereavement counselor, will explore the process of grieving and the role it plays in mediation of elder-related conflicts. The panel will help attendees understand the psychological and biological processes of grieving; consider how grief “shows up” in their work; examine their own internal responses to grief in mediations; and develop practical approaches for working with clients who have experienced or are anticipating loss effectively.
