Course Content & Objectives
This workshop introduces experienced mediators to the field of elder mediation in its many forms, from facilitating meetings in which families must make difficult decisions, to mediating family disputes concerning a parent, to mediating litigated cases involving elders or their families.
In this experiential workshop, we will explore:
• The universe of elder mediation
• Unique aspects of elder mediation
• The elder mediation process – intake and assessment, case development, process design and mediation plans, managing multiparty conversations and follow-up
• The art of communicating with older people
• Adult development and the experience of aging
• Mediator qualities – the role of mindfulness, understanding and compassion
• Ageism and stereotyping of elders
• Participation of the aging adult – issues of capacity, representation and accommodation
• Skills to manage family dynamics and conversation
• Distinctions between mediation and therapy
• Resources for aging adults
• Ethical and legal issues unique to elder mediation
• Mediating litigated cases involving elder issues – elder abuse, trusts & estates, conservatorships
• Special issues: grief, apology and forgiveness
• The elder mediation practice
